1. Agreement to Terms
By accessing or using MoltFlow ("Service"), operated by WaiFlow ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our Service.
These Terms constitute a legally binding agreement between you and WaiFlow. Please read them carefully before using our Service.
2. Critical: Third-Party Dependencies & WhatsApp Disclaimer
⚠️ IMPORTANT: READ THIS SECTION CAREFULLY BEFORE USING MOLTFLOW.
MoltFlow is NOT affiliated with, endorsed by, certified by, or in any way officially connected with WhatsApp, Meta Platforms, Inc., or any of their subsidiaries or affiliates. The name "WhatsApp" as well as related names, marks, emblems, and images are registered trademarks of their respective owners.
MoltFlow relies on third-party services and platforms that we do not own, control, or operate.
WhatsApp Integration
MoltFlow connects to WhatsApp using proprietary integration technology. This is NOT the official WhatsApp Business API provided through the Meta Business Platform. Our integration method is unofficial and is not endorsed, supported, or guaranteed by Meta or WhatsApp. WhatsApp may change its terms, policies, security measures, or technical implementation at any time without notice, which may directly impact MoltFlow's functionality, availability, or your ability to use the Service.
No Official Partnership with Meta
Unlike services that use the official WhatsApp Business API, MoltFlow's connection method is not officially sanctioned. This means: (1) No guaranteed uptime or SLA from Meta/WhatsApp; (2) Potential for service disruption without warning; (3) Higher risk of WhatsApp account restrictions, suspension, or permanent ban compared to official API users; (4) No direct support from Meta/WhatsApp for technical issues arising from the use of MoltFlow.
Account Risk Acknowledgment
By using MoltFlow, you acknowledge that connecting your WhatsApp account to any third-party service carries inherent risk. WhatsApp actively monitors accounts for unusual activity, policy violations, and unauthorized third-party access. MoltFlow does NOT guarantee that your WhatsApp account will not be banned, suspended, restricted, or permanently terminated. No WhatsApp automation platform can guarantee 100% account safety. You use MoltFlow and connect your WhatsApp account entirely at your own risk.
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:
- MoltFlow's functionality depends on the continued availability and compatibility of WhatsApp and our integration technology.
- We cannot guarantee uninterrupted service if WhatsApp changes its systems, policies, or enforcement practices.
- We are not responsible for any service disruption caused by WhatsApp, Meta, or changes to their platform.
- Your WhatsApp account may be banned, suspended, or terminated as a result of using MoltFlow or any similar automation tool, and we bear no liability for such outcomes.
- Your use of MoltFlow is at your own risk regarding third-party dependencies and account safety.
- We may be forced to modify, suspend, or discontinue the Service entirely if our integration with WhatsApp becomes unavailable or incompatible.
- You are solely responsible for maintaining backups of your WhatsApp data and contacts.
3. WhatsApp Policy Compliance & Account Risk
You are solely and entirely responsible for ensuring that your use of MoltFlow complies with all applicable WhatsApp and Meta policies, including but not limited to:
- WhatsApp Terms of Service (whatsapp.com/legal/terms-of-service)
- WhatsApp Business Messaging Policy
- WhatsApp Commerce Policy
- Meta Community Standards
- All applicable local, national, and international laws including but not limited to GDPR, CCPA, CAN-SPAM, TCPA, ePrivacy Directive, and equivalent legislation in your jurisdiction
Prohibited Activities:
- Spam & Unsolicited Messaging: Sending unsolicited bulk messages, automated messages to users who have not opted in, or messages that recipients have not consented to receive.
- Harassment & Abuse: Using the Service to harass, threaten, intimidate, stalk, or abuse any individual or group.
- Fraud & Deception: Phishing, scams, social engineering, impersonation of individuals or organizations, or any deceptive practices.
- Malware & Harmful Content: Distributing viruses, trojans, ransomware, spyware, malicious links, or any harmful content.
- Illegal Content & Activities: Any content or activity that violates applicable laws, including promotion of illegal goods or services.
- Privacy Violations: Collecting, harvesting, or processing personal data without proper legal basis and informed consent.
- Circumvention: Attempting to bypass WhatsApp's security measures, rate limits, or account restrictions using the Service or any other means.
- Reselling or Sublicensing: Reselling, sublicensing, or providing MoltFlow access to third parties without authorization.
- Reverse Engineering: Reverse engineering, decompiling, or attempting to extract the source code of the Service or its integration technology.
- Automated Account Creation: Using the Service to create WhatsApp accounts or to automate WhatsApp account registration.
- Excessive Load: Intentionally generating excessive load on the Service or using it in a manner that degrades performance for other users.
ACCOUNT SUSPENSION & BAN DISCLAIMER:
WhatsApp actively monitors accounts for policy violations, unusual activity, and unauthorized third-party access. WhatsApp may ban, suspend, restrict, or permanently terminate accounts at their sole discretion and without prior notice. MOLTFLOW IS NOT 100% BAN-SAFE. NO WHATSAPP AUTOMATION PLATFORM CAN GUARANTEE THAT YOUR ACCOUNT WILL NOT BE BANNED.
WE ARE NOT RESPONSIBLE IF YOUR WHATSAPP ACCOUNT IS BANNED, SUSPENDED, RESTRICTED, OR PERMANENTLY TERMINATED due to your use of MoltFlow, your messaging practices, WhatsApp's enforcement actions, or for any other reason. You use MoltFlow and connect your WhatsApp account entirely at your own risk. We strongly recommend:
- Not connecting your primary personal WhatsApp number
- Maintaining backups of important contacts and conversations
- Following all WhatsApp policies and best messaging practices
- Starting with low message volumes and gradually increasing
- Monitoring your account health and adjusting behavior if you receive warnings
4. Anti-Spam Guidelines
MoltFlow has a zero-tolerance policy for spam. You must comply with all anti-spam laws and WhatsApp policies.
Required Practices:
- Opt-in Only: Only message users who have explicitly consented to receive messages from you.
- Easy Opt-out: Provide a clear and immediate way for recipients to unsubscribe.
- Message Limits: Respect rate limits and avoid excessive messaging frequency.
- Accurate Sender Info: Clearly identify yourself or your business in all messages.
- Relevant Content: Only send content relevant to what users opted in for.
Strictly Prohibited:
- Purchasing or using contact lists without verified consent
- Sending messages to users who have not explicitly opted in
- Ignoring or delaying unsubscribe requests
- Using deceptive subject lines or content
- Harvesting phone numbers from public sources
- Automated mass messaging without rate limiting
- Sending messages outside reasonable business hours without consent
VIOLATION CONSEQUENCES:
Violations of anti-spam policies will result in immediate account suspension or termination without refund. We may also report violations to WhatsApp and relevant authorities.
5. Message Processing & AI Usage
MoltFlow processes messages using artificial intelligence and automated systems. By using our Service, you acknowledge and consent to the following:
How We Process Messages:
- Message Storage: A preview of each message (first 500 characters) is stored to enable delivery tracking, conversation history, and feature functionality. Full message content is not retained.
- AI Analysis: Messages may be analyzed by AI for features like auto-responses, lead detection, sentiment analysis, and smart labeling.
- Third-Party AI (OpenAI): When AI-powered features are enabled, message content is sent to OpenAI (San Francisco, CA, USA) for processing. OpenAI acts as a sub-processor under contractual data protection obligations. Data may be transferred to the United States under Standard Contractual Clauses.
- Style Training: If you enable Learn Mode, your outbound messages are analyzed to extract statistical writing patterns (word frequency, formality score, emoji usage). Only aggregate statistics are stored in your style profile, not the original message text.
- Knowledge Base (RAG): Documents you upload to the knowledge base are chunked, embedded as vectors, and stored for retrieval-augmented generation. Document text is stored alongside embeddings to provide context to AI responses.
- Metadata Processing: Message timestamps, read receipts, and delivery status are processed for analytics and delivery tracking.
Data Retention:
- Message previews: Automatically deleted after 90 days from the date of the message.
- Message metadata (timestamps, delivery status): Retained for up to 1 year for analytics purposes.
- AI audit logs: Retained for 90 days.
- Knowledge base documents: Retained until you delete them or your account is terminated.
- Style profiles: Retained until you delete them or your account is terminated.
- Collected reviews: Retained for 90 days, then automatically deleted.
- Backups: Deleted messages may persist in database backups for up to 30 days.
- Analytics: Aggregated, anonymized analytics data may be retained indefinitely.
Your Responsibilities as Data Controller:
When you use MoltFlow to process messages from your contacts, you act as the Data Controller for your contacts' personal data, and MoltFlow acts as your Data Processor. You are responsible for:
- Informing your contacts that their messages are processed by MoltFlow and may be analyzed by AI systems
- Providing your contacts with access to MoltFlow's Privacy Policy
- Obtaining necessary consents for AI processing where required by applicable law
- Handling data subject requests (access, erasure, portability) from your contacts
- Not sending sensitive personal data (health, financial, legal) through the Service without appropriate safeguards
- Complying with GDPR, CCPA, and all other applicable data protection laws in your jurisdiction
Bulk Messaging & Campaign Responsibilities:
- You are solely responsible for the content of all bulk messages and campaigns sent through MoltFlow.
- MoltFlow applies anti-spam rate limiting (delays between messages) to protect your account, but this does not guarantee account safety.
- Sending bulk messages to contacts who have not opted in is a violation of these Terms, WhatsApp policies, and may violate applicable laws.
- Campaign analytics (delivery, read, reply, reaction tracking) rely on WhatsApp's delivery infrastructure and may not always be accurate or complete.
Scheduled Messages:
- Scheduled and recurring messages are executed automatically at the configured time. You are responsible for the content and timing of all scheduled messages.
- We do not guarantee exact delivery times. Scheduled messages may be delayed due to system load, WhatsApp availability, or queue processing.
- If your WhatsApp session is disconnected at the scheduled time, messages will fail and may not be automatically retried.
Group Monitoring & Lead Detection:
- Group monitoring features observe messages in WhatsApp groups you are a member of. You must comply with the group's rules and WhatsApp's policies regarding group participation.
- Lead detection uses AI analysis and may produce false positives or false negatives. You should independently verify all detected leads.
- You are responsible for ensuring that any outreach to detected leads complies with applicable anti-spam and privacy laws.
AI DISCLAIMER:
AI-generated responses, lead scores, sentiment analysis, transcriptions, and all other AI-powered features are provided for convenience and may contain errors, inaccuracies, or inappropriate content. AI features are powered by OpenAI and are subject to OpenAI's capabilities and limitations. You are solely responsible for reviewing, approving, and supervising any automated or AI-generated messages before and after they are sent. We are not liable for any damages, losses, missed opportunities, or adverse outcomes arising from AI-generated content, incorrect lead scoring, inaccurate sentiment analysis, or any other AI output.
6. Service Description
MoltFlow is a WhatsApp automation platform provided on an "as is" and "as available" basis. The Service includes, but is not limited to, the following features:
- WhatsApp Session Management: Connect and manage one or more WhatsApp accounts via QR code linking, with real-time connection status monitoring.
- Messaging: Send and receive text messages, view conversation history, and track message delivery, read receipts, and reactions.
- Bulk Messaging & Campaigns: Send messages to custom contact groups with built-in anti-spam rate limiting. Campaign analytics track delivery, read, reply, and reaction rates.
- Scheduled Messages: Schedule one-time or recurring messages (daily, weekly, monthly) for automated delivery to custom contact groups.
- AI-Powered Features: Auto-responses, lead detection and scoring, sentiment analysis, smart labeling, voice message transcription, and knowledge base (RAG) powered by OpenAI.
- Style Training (Learn Mode): Opt-in feature that analyzes your outbound messages to extract statistical writing patterns for AI-generated responses that match your communication style.
- Knowledge Base (RAG): Upload documents that are chunked, embedded as vectors, and used for retrieval-augmented generation to improve AI response accuracy.
- Group Monitoring & Lead Mining: Monitor WhatsApp groups for potential leads using configurable detection modes (all messages, first contact, or keyword-based).
- Custom Contact Groups: Create and manage contact groups from WhatsApp group participants, labels, or manual entry for targeted outreach.
- Review Collection: Automated collection and management of customer reviews via WhatsApp conversations.
- Agent-to-Agent (A2A) Communication: Inter-agent protocol support for automated agent communication with content safety policies and trust levels.
- MCP Server Integration: Model Context Protocol server for programmatic access to MoltFlow capabilities by AI agents and external tools.
- Webhooks: Real-time event notifications delivered to your endpoints for message events, lead detections, and other platform activities.
- API Access: RESTful API with scoped API keys for programmatic access to all platform features.
- Analytics & Reporting: Campaign engagement funnels, contact engagement leaderboards, usage statistics, and customizable reports with scheduled execution.
- Onboarding Wizard: Guided setup flow for new users to connect their WhatsApp account and configure initial settings.
- GDPR Compliance Tools: Data export, contact erasure, and consent management features to support your data protection obligations.
Feature availability depends on your subscription plan. We reserve the right to modify, add, remove, suspend, or discontinue any feature or part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
7. User Accounts
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized use of your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
8. Payment Terms & Refund Policy
Billing:
- Paid plans are billed in advance on a monthly basis via Stripe.
- All payment processing is handled by Stripe, Inc. We do not store your credit card details.
- Plan features and limits (messages, sessions, monitored groups, bulk sends, scheduled messages, API calls) are enforced according to your active subscription tier.
- Upgrading your plan takes effect immediately. Downgrading takes effect at the end of your current billing period.
- We reserve the right to change pricing with 30 days written notice. Existing subscribers will be notified via email before any price change takes effect.
- Failure to pay may result in suspension or termination of your account and loss of access to your data after the retention period.
- You are responsible for any applicable taxes, duties, or levies imposed by your jurisdiction.
Refund Policy:
- All fees are generally non-refundable. This includes fees for partial months of service, unused features, or plan downgrades mid-cycle.
- If the Service experiences a material, prolonged outage (exceeding 72 continuous hours) caused by us and not by third-party dependencies, you may request a pro-rated credit for the affected period by contacting [email protected].
- No refunds will be issued for WhatsApp account bans, suspensions, or restrictions, as these are outside our control.
- No refunds will be issued for service disruptions caused by WhatsApp, Meta, or any third-party platform changes.
- Accounts terminated due to Terms violations are not eligible for any refund.
Free Plan:
The free plan is provided at our discretion and may be modified, limited, or discontinued at any time without notice. Free plan users are subject to the same Terms and obligations as paid users.
9. Intellectual Property
The Service, including its original content, features, and functionality, is owned by WaiFlow and is protected by international copyright, trademark, and other intellectual property laws.
You retain ownership of any content you submit through the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content solely for the purpose of providing the Service.
10. API Access, Webhooks & Integrations
API Keys & Access:
- API keys grant programmatic access to your MoltFlow account with specific scoped permissions. You are responsible for keeping your API keys confidential and secure.
- Any actions performed using your API keys are your responsibility, regardless of who performed them.
- If you believe your API key has been compromised, you must revoke it immediately through the dashboard and generate a new one.
- API rate limits are enforced per your subscription plan. Exceeding rate limits may result in temporary request throttling.
Webhooks:
- Webhooks deliver real-time event notifications to URLs you specify. You are responsible for securing your webhook endpoints and validating webhook signatures.
- We do not guarantee delivery of webhook events. Events may be delayed, duplicated, or lost due to network issues or endpoint failures.
- Failed webhook deliveries are retried on a best-effort basis. We are not liable for missed events or downstream effects of webhook delivery failures.
Agent-to-Agent (A2A) & MCP:
- A2A and MCP features enable automated inter-agent communication and programmatic platform access. You are responsible for configuring appropriate content policies, trust levels, and safety guardrails.
- You are solely responsible for the behavior and output of any AI agents that interact with your MoltFlow account, whether through A2A, MCP, or the API.
- Messages sent by AI agents through your account are treated the same as messages you send manually for the purposes of these Terms, WhatsApp policy compliance, and anti-spam rules.
11. Data Processing & GDPR
By using MoltFlow, you acknowledge that:
- Message previews (first 500 characters) are stored for up to 90 days to enable delivery tracking, conversation history, and AI features, then automatically deleted.
- We use OpenAI as a sub-processor for AI-powered features including auto-responses, lead detection, and sentiment analysis.
- You are responsible for obtaining necessary consents from individuals whose data you process through our Service.
- We process data in accordance with our Privacy Policy.
Data Processing Agreement (DPA):
If you process personal data of individuals in the European Economic Area (EEA), United Kingdom, or Switzerland through our Service, you act as the Data Controller and MoltFlow acts as your Data Processor. By using the Service, you agree to the terms of our Data Processing Agreement, which governs our processing of personal data on your behalf.
Sub-Processors:
We use the following sub-processors to provide the Service:
- OpenAI, LLC (San Francisco, CA, USA) — AI text generation, voice transcription, and message analysis
- Stripe, Inc. (San Francisco, CA, USA) — Payment processing
- Twilio SendGrid (San Francisco, CA, USA) — Transactional email delivery
- Hetzner Online GmbH (Gunzenhausen, Germany) — Infrastructure hosting
We will notify you at least 30 days before adding or changing sub-processors. You may object to a new sub-processor by contacting us within that period. If we cannot reasonably accommodate your objection, you may terminate your account.
Automated Decision-Making:
MoltFlow uses automated processing for lead scoring, sentiment analysis, and message labeling. These automated decisions help prioritize conversations but do not produce legal effects or similarly significant effects on individuals. You can review and override any automated decisions through the dashboard.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WAIFLOW, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, revenue, data, goodwill, or business opportunities
- Any damages arising from your use of or inability to use the Service
- Any damages arising from third-party service failures, including WhatsApp, Meta, OpenAI, or any platform dependency
- Any damages arising from WhatsApp account suspension, restriction, ban, or termination
- Any damages arising from inaccurate AI analysis, lead scoring, sentiment detection, or automated responses
- Any damages arising from failed, delayed, or undelivered messages, including scheduled messages and bulk campaigns
- Any damages arising from webhook delivery failures or API service interruptions
- Any damages arising from actions taken by AI agents connected via A2A or MCP
- Any unauthorized access to or alteration of your transmissions or data
- Any loss of contacts, messages, or data resulting from service interruption or account termination
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE).
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
WE DO NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) DEFECTS WILL BE CORRECTED; (C) THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; (D) THE RESULTS OF USING THE SERVICE (INCLUDING AI-GENERATED CONTENT, LEAD SCORING, ANALYTICS, AND CAMPAIGN RESULTS) WILL MEET YOUR REQUIREMENTS OR BE ACCURATE; (E) YOUR WHATSAPP ACCOUNT WILL REMAIN ACTIVE AND IN GOOD STANDING; OR (F) THE SERVICE WILL REMAIN COMPATIBLE WITH WHATSAPP OR ANY THIRD-PARTY PLATFORM.
WE MAKE NO WARRANTY REGARDING THE RELIABILITY, ACCURACY, TIMELINESS, USEFULNESS, OR COMPLETENESS OF ANY AI-POWERED FEATURES, MESSAGE DELIVERY, CAMPAIGN ANALYTICS, LEAD DETECTION, WEBHOOK EVENTS, OR ANY OTHER ASPECT OF THE SERVICE.
14. Indemnification
You agree to indemnify, defend, and hold harmless WaiFlow and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
- Your use of the Service, including messages sent, campaigns executed, and AI features utilized
- Your violation of these Terms or any applicable WhatsApp, Meta, or third-party policies
- Your violation of any rights of another party, including privacy and data protection rights
- Your violation of any applicable laws or regulations, including anti-spam and data protection laws
- Content you send, upload, or process through the Service, including messages, knowledge base documents, and AI training data
- Actions taken by AI agents you have configured to interact with the Service
- Any claim by a third party (including your contacts) arising from messages sent through your account
15. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms, violate WhatsApp policies, engage in spam or abuse, or if we are required to do so by law.
Upon termination: (a) your right to use the Service will immediately cease; (b) any scheduled messages, active campaigns, and automated features will be stopped; (c) your API keys will be revoked; (d) your data will be handled according to our Data Processing Agreement.
You may terminate your account at any time through the dashboard or by contacting us. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, limitations of liability, and dispute resolution provisions.
16. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which WaiFlow is registered, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the Service shall first be addressed through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to the exclusive jurisdiction of the courts in the jurisdiction where WaiFlow is registered.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
18. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. For significant changes, we will also notify you by email. Your continued use of the Service after such changes constitutes acceptance of the new Terms. If you do not agree with the updated Terms, you must stop using the Service and close your account.
